CONSENT TO TERMS AND CONDITIONS

Access to and use of the services provided by World Cultural Tours, Inc. (hereafter may be referred to as “WCT” and/or “its”) and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser and/or traveler (“Customer” and “passenger” and “you/your”) agree to be bound by these terms. PLEASE READ THE TERMS BEFORE USING THIS WEBSITE. These terms and conditions govern the relationship between WCT and you, the Customer. These terms restrict your rights and remedies and provide protection to WCT. These also include warranty disclaimers and liability exclusions. By using this website you acknowledge and agree (a) this is a fair balance because this website is accessible by you conveniently and at no charge to access the website; and (b) if you do not agree or do not accept these Terms and Conditions, you can choose to not use this website or WCT offices. So, if anything is in these Terms and Conditions, including warranty disclaimers and liability exclusions, that you disagree with or are not willing to be bound by, or if something is missing from these Terms and Conditions that you consider essential, then you must not use this website. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR WCT’S SERVICES. No alterations to these terms and conditions may be made by any WCT employee, authorized representative or agent, unless in writing by an authorized officer of WCT.


TRAVELER & GROUP RESPONSIBILITIES
A NONREFUNDABLE REGISTRATION FEE OF $200/PER PERSON, PER TOUR MUST BE COLLECTED BY WCT BEFORE ANY TOUR ARRANGEMENTS WILL BE BOOKED.  
 
120-Days prior to the tour’s departure date, the number of ground and air bookings will be reduced based on the number of tour registrants who are paid in full by that date. Additional space may be available on a request only basis and may incur additional costs. Passengers not paid in full by 120-Days will be subject to WCT’s Cancellation Policy outlined below. 
 
IT IS THE SOLE RESPONSIBILITY OF EACH TRAVELER TO OBTAIN AND PROVIDE ACCURATE INFORMATION FOR ANY AND ALL NECESSARY DOCUMENTS REQUIRED TO TRAVEL WITH WCT; THIS INCLUDES A PASSPORT, VISA, REAL ID, ETC.
 
A VALID PASSPORT IS REQUIRED FOR ALL INTERNATIONAL TRAVELERS and must be valid at least six (6) months after your tour return date. Please note that passport cards are not considered valid for international travel.  For domestic travel within the continental USA, a passport is not required for US Citizens, however, an unexpired form of local or federal government-issued photo ID (passport, driver’s license, military ID) is required for all adult passengers (18 and over).  
 
  • NON-US CITIZENS/TRAVELERS WITHOUT AMERICAN PASSPORT: A Travel Visa may be required for any Non-US Citizens/Travelers without American Passports who are traveling internationally. It is the responsibility of the traveler to contact the embassy of any countries that will be visited during the tour (including countries visited during flight layovers) to determine whether a travel visa is required and for further information about the application process. Any visas must be obtained as the sole responsibility of the individual traveler.  If you need a travel visa, World Cultural Tours (WCT) requires that you submit written verification that a visa has been obtained or a photocopy of your visa, no later than fifteen (15) days prior to the departure date of your tour. Additionally, WCT does not accept liability in the case of any passenger(s) being denied boarding by any airline carrier due to insufficient documentation and/or carrier’s overbooking of a flight.


TRAVEL PROTECTION/ INSURANCE
WORLD CULTURAL TOURS (WCT) STRONGLY RECOMMENDS EACH TRAVELER PURCHASE TRAVEL PROTECTION.  
 
TRAVEL PROTECTION PREMIUMS ARE BASED ON THE CONTRACTED TOUR PRICE AND ARE NOT INCLUDED IN THE LISTED TOUR PRICE.  
 
TRAVEL PROTECTION PREMIUMS MUST BE PAID UPON SUBMISSION OF REGISTRATION.
 
TRAVEL PROTECTION PREMIUMS ARE NONREFUNDABLE AT THE POINT OF SALE.

 
WCT, acting solely as a group tour operator and not as an insurance provider, offers travelers protection options through a third party travel insurance provider. It is the traveler’s responsibility to review policy information, understand coverage, and provide all required documentation to the third party insurance provider. IF at 120-Days prior to the tour’s departure date, a group does NOT meet the minimum six (6) participant requirement to be eligible to receive group travel protection rates - travelers will be notified by WCT and their account will reflect credit in the amount of the paid premium.
 
Employees of WCT are not qualified or authorized to: answer technical questions about benefits, exclusions, coverage, claim status, and/or conditions of any purchased insurance plan, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. All insurance inquiries, questions, and discussions must be directed to the insurance provider.
 
Without appropriate travel insurance, the traveler understands and agrees that if the traveler or group cancels or interrupts tour arrangements for any reason, WCT has the sole discretion to decide what if any portions of the tour may be refunded. Cancellation policies of WCT and its service suppliers will be applied, resulting in the loss of the traveler’s monies up to the full cost of the tour price and related costs.

DEVIATION REQUESTS
Deviations are individual modifications to the group’s air reservation. A Deviation Request Form must be completed and submitted to WCT with the nonrefundable administration fee of $200.00/per person prior to WCT’s research and cost estimate.  All additional costs for deviation arrangements will be the responsibility of the traveler and are nonrefundable. 

Deviation Revision Fees:
A handling fee of $25.00 per transaction will be assessed for any change or revision made to a reservation. A change of departure date within 11 months of departure will be treated as a cancellation, and cancellation charges will apply. Deviation Request Forms will NOT be accepted or processed if received by WCT 120-0 days prior to the tour’s departure.
 
Deviation arrangements are NOT covered by the group travel protection plan. Travelers with Deviations may purchase individual travel protection and can do so at: Retail/Individual Travel Protection Options.


LAND-ONLY REQUESTS
Land-Only requests are available to travelers who choose not to take part in the group air reservations secured by WCT.  A Land-Only Form must be completed and submitted to WCT prior to 120-Days from the tour’s departure date. Land-only requests will not be accepted or processed at any time within 120 days prior to the tour's departure. Land-Only travelers are responsible for all travel arrangements required to join the group.
 
The Land-Only price will be reflected on the traveler's account only when the Land-Only Form has been received by WCT. 


TOUR PRICE
The final tour price is based on the actual number of paying passengers and is subject to increase if minimum paying passenger requirement has not been met.  WCT reserves the right to cancel or modify any tour arrangements and/or the tour price due to insufficient participation and/or force majeure. WCT is not responsible for any costs incurred from itinerary/tour arrangement modifications; any additional incurred costs will be the responsibility of the group/organization/entity and/or traveler.
 
All registrants are invoiced with single occupancy rates if no roommate is specified.  WCT will adjust rooming lists & invoices only when WCT receives written notification - which includes online registration- of roommate preference(s). It is the traveler’s responsibility to find a roommate. It is the group organizer’s responsibility to notify WCT in writing of how they would like to match any unpaired travelers as roommates. 
 
Tour price is based on the costs, charges, fees, exchange rates, etc. at the time of booking. In case that currency fluctuates by 3% or more, WCT reserves the right to adjust the tour price accordingly. Any domestic and/or international residency taxes, departure or arrival taxes, security charges, baggage fees, airline and/or airport fees, port taxes, or any other surcharges are NOT included in the tour price and are the responsibility of the traveler.


SCHOLARSHIP / FINANCIAL ASSISTANCE
Any and ALL scholarship monies to be applied to a traveler's account must be received by WCT120 days prior departure. NO EXCEPTIONS. A detailed list of scholarship allotments must be supplied by the group/ organization/ entity at the time of payment. WCT must be notified in advance of 120 days prior departure of any expected scholarship monies to be received.
 
If an INDIVIDUAL traveler, who has received scholarship monies cancels participation of tour, scholarship monies will be subject to (1) or more of the following:
 
  • Scholarship money will be moved to another passenger’s account on the same tour, at the discretion of the group leader/organization.
  • Scholarship money will be applied to the cancellation fee according to WCT Terms and Conditions.
  • Scholarship money will be refunded directly to the organization. Under no circumstance will Scholarship money be refunded to passengers.

TOUR PAYMENTS
Payment of the deposit to World Cultural Tours (WCT) constitutes acceptance of these terms and conditions. WCT reserves the right to modify these terms and conditions at any time, without notice.

Final payment is due prior to departure or use of services according to each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is NOT received by the applicable due date, reservations are subject to WCT Cancellation forfeiture. In some cases, there is NO REFUND once a booking is made and paid for. Travelers have limited rights to a refund for change of travel plans.

  • (ONLINE) ACH/ Electronic Check
    • This method incurs no additional fees.
    • Please provide all accurate information at the time of payment submission. If payment is declined, due to erroneous information, a $50 service fee will be incurred, as payment will reflect non-sufficient funds (NSF).
    • WCT will not issue any refund or cash reimbursement through ACH/ electronic check.
 
  • (ONLINE) Credit Card
    • WCT accepts all major Credit Cards
    •  A nonrefunable service fee of $30 will be charged per every credit card transaction.
    •  By submitting payment by credit card, the traveler agrees to ALL WCT Terms and Conditions.
    •  In the event of refund, all credit(s) will be issued back to the Credit Card utilized at the time of payment(s).
      • For security reasons, Credit Card refunds are only applicable 120 days after the original transaction and must be equal to or less than the original payment amount. If a refund is not available for issuance on Credit Card a check will be mailed via USPS Standard Delivery.
      • Passengers are given the opportunity to submit incremental payments towards the total cost of the tour; therefore, not all credits qualify for issuance by method of credit card.
    • If you feel there has been an error with a submitted Credit Card transaction, please immediately contact WCT directly to resolve the issue.  Do NOT dispute and/or issue a chargeback.
    • In response to a Credit Card dispute and/or chargeback, WCT will issue a rebuttal providing all signed documents of Traveler agreeing to WCT Terms and Conditions.
      • A NONREFUNDABLE fee of $50 will be charged to the traveler's account for each Credit Card dispute/ chargeback as it will reflect NSF.
    • In the event of cancellation, a traveler will not be offered any refund, credit, tour voucher, or cash reimbursement if the account has an open Credit Card dispute/chargeback.
 
  • (NOT ONLINE) Paper/ Physical Check
    • Payments can be made by check. A $50 NSF Check Fee will be assessed for any returned check. Please make all checks payable to:

IMPORTANT: WCT reserves the right to require final payment via credit card or electronic check in the event of a past-due balance that needs to be expedited. Furthermore, WCT reserves the right to cancel all tour arrangements for traveler(s) with past-due balances; however, WCT will make every effort to contact said traveler(s) prior to taking this action. 


CANCELLATION POLICY
THE $200/PER PERSON REGISTRATION FEE IS NONREFUNDABLE AND WILL NOT BE REFUNDED TO TRAVELERS AND/OR GROUPS OF A CANCELED TOUR.
 
WCT MUST RECEIVE ALL CANCELLATION REQUESTS IN WRITING.  

 
The traveler is advised of cancellation fees at the time of booking, a copy will be provided to the traveler upon confirmation. All cancellation fees will be charged to the credit card authorized by the cardholder to pay for travel services or deducted from the supplier’s refund. 
 
  • INDIVIDUAL/DEVIATION CANCELLATION: Individual cancellations are only effective when WCT receives written notification of a traveler’s individual cancellation. Travelers may submit cancellation notices to: accounting@worldculturaltours.com. Travel protection premiums and additional nonrefundable fees that are owed or already paid out to service suppliers for the tour (i.e.: Airline deposits, ground supplier,  hotel deposits, transportation deposits, venue and performance fees, nonrefundable entrance fees or performance tickets) as well as any unused tour portions and/or the costs of services received while traveling will be directly incurred by the traveler.
  
  • GROUP CANCELLATION: In the event that a group/organization/entity must cancel in full due, written notification must be received by WCT no later than 120-Days prior to the tour’s departure. Any group cancellation notification that WCT receives within 120 - 0 days of the tour’s departure will subject all travelers and/or group organizers to WCT’s Cancellation Policy outlined below. Travelers are also subject to additional nonrefundable fees that are owed or already paid out to service suppliers (i.e.: Airline deposits, ground suppliers, hotel deposits, transportation deposits, venue and performance fees, nonrefundable entrance fees or performance tickets). 
 
IT IS THE SOLE RESPONSIBILITY OF THE GROUP AND/OR GROUP ORGANIZER TO NOTIFY ALL TOUR REGISTRANTS OF THE TOUR’S OFFICIAL GROUP CANCELLATION. 
 
Up to 121 days prior to the tour's departure date, refund less Travel Protection Premiums and the non-refundable $200/Per Person Registration Fee will be granted. Once within 120 days prior to the tour's departure date, the following additional cancellation fees will be incurred by the individual traveler:   
 
  • 120-91 days prior to departure: Loss of deposit and nonrefundable $200/PP  Registration Fee.                                  
  • 90-61 days prior to departure: 35% of total tour price is forfeited and nonrefundable $200/ Registration Fee
  • 60-46 days prior to departure: 60% of total tour price is forfeited and nonrefundable Registration Fee
  • 45-0 days prior to departure: 100% of total tour price is forfeited
 
WCT’s standard Cancellation Policy protects the nonrefundable and unrecoverable investments WCT must make on behalf of a group, protecting the quality and price of the tour for each traveler. The WCT cancellation policy is non-negotiable. 


REFUNDS
All information regarding refunds, credits, vouchers, and/or cash reimbursements will be supplied both to the traveler and the travel insurance company, in compliance with insurance company policies and procedures.
  • INDIVIDUAL REFUNDS: If the traveler’s account has an open balance when WCT receives written notification of individual cancellation, they will only be refunded the amount paid in accordance to WCT’s Cancellation Policy. Minimum individual refund processing time is 30 days after written cancellation notice has been received by WCT.
 
  • REFUND OF SCHOLARSHIP MONIES: In the event of a Group Cancellation and ONLY if and when each scholarship recipient has met the required fees outlined in WCT’s Cancellation Policy, the remaining balance of scholarship monies will be refunded to the contributing organization. Contributing organization(s) must submit and confirm payee name and address to WCT before any refund will be issued. Scholarship refund(s) will be issued in the form of check and mailed to the contributing organization via USPS Standard Delivery 
 
  • FORCE MAJEURE REFUNDS: In the event of a tour cancellation due to force majeure and travelers are within 100% penalty, WCT will work on behalf of the group and/or individual traveler to recover any monies, travel credits, airline waivers, ground vouchers, etc. Only if available, recovered monies will be offered to the group/organization/entity and/or the traveler. In some cases, no refund may be available once tour arrangements have been secured and paid for on the group’s and/or traveler’s behalf. In the event of a tour cancellation due to force majeure and travelers are not yet within 100% penalty, WCT will issue refunds in accordance with WCT’s Cancellation Policy. WCT has the right of a minimum 120-day duration to work with suppliers on recovering any monies before notifying the group organization and or traveler of available refunds, credits, vouchers, and/or cash reimbursements.

WCT IS NOT LIABLE FOR ANY NONRECOVERABLE MONIES AND MUST ABIDE BY INDIVIDUAL SUPPLIER’S TERMS AND CONDITIONS. 


LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
World Cultural Tours (WCT) acts solely as a group tour operator for disclosed principal supplier, hotels, airlines, air charters, bus companies, ground transportation, cruise lines, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”), and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management, and is not subject to the control of WCT.  WCT must adhere to the Terms and Conditions of each service supplier (airlines, hotels, etc.)
 
Because WCT acts as a group tour operator for disclosed principal suppliers and does not have the right to control the operations of such independent operators and suppliers, you agree WCT is not liable for any personal injury or property damage, which may arise out of these services. WCT hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special, consequential, incidental or indirect damages in connection with the goods or services provided by any principal supplier used by WCT, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, wilful acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, fuel increases, and other matters outside of WCT’s control, and you hereby exonerate WCT from any liability with respect to the same.
 
Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of WCT’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of WCT.  WCT reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary. WCT reserves the right to refuse or retain a traveler’s registration based on any threat that individual may cause as indicated in writing by a group leader.  WCT shall not assume any responsibility for any air and/or ground schedule changes. WCT has solely received service fees for each tour; the traveler agrees and understands that any recovery from WCT will be limited to the amount actually received by WCT from the traveler.


FORCE MAJEURE
“Force Majeure” means, in relation to World Cultural Tours (WCT), any circumstances beyond the reasonable control of WCT including, but without limitation to Acts of God, explosion, epidemic, pandemic, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention/shutdown, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences.
 
WCT shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the traveler, by reason of delay or non-execution, of its obligations hereunder to the extent that any such delay or non-execution is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
 
If WCT, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to and may in their sole and absolute discretion, alter or cancel any itinerary or arrangement in relation to a tour. WCT payment of any refund to a traveler by WCT as a result of the non-execution of obligations hereunder shall remain in its sole and absolute discretion. WCT shall use its reasonable efforts to reimburse the traveler where possible. WCT shall be entitled to deduct from any recouped losses the reasonable actual and potential costs of services to WCT of the Force Majeure and applicable cancellation fees. Regarding civil unrest, it is WCT’s sole and absolute discretion whether to proceed with the trip. The traveler/group organizer may in such circumstances cancel the trip subject to WCT’s Cancellation Policy.


ERRORS AND OMISSIONS
While every effort is made to ensure the accuracy of the information in our brochures, on our website or communicated by a WCT team member - errors or omissions are possible and WCT is not responsible for such errors. If a mistake is made in billing, we reserve the right to correct the invoice and you will be responsible for proper payment.


SEVERABILITY
In the event that any clause in this agreement is determined to be invalid, the remaining provisions are valid and enforceable. The invalid provision shall be replaced by WCT by a clause as similar as practicable.

PRIVATE POLICY
  • How the information is used
    • The information is used to enhance the visitor’s experience when using the website to display personalized content and possibly advertising. E-mail addresses will not be sold, rented or leased to 3rd parties. E-mail may be sent to inform you of news of our services or offers by us, or our affiliates.
  • Visitor Options
    • If you have subscribed to one of our services, you may unsubscribe by following the instructions, which are included in e-mail that you receive. You may be able to block cookies via your browser settings but this may prevent you from access to certain features of the website.
  • Cookies
    • Cookies are small digital signature files that are stored by your web browser that allow your preferences to be recorded when visiting the website. Also they may be used to track your return visits to the website. 3rd party advertising companies may also use cookies for tracking purposes.
  • Google Ads
    • Google, as a third party vendor, uses cookies to serve ads. Google's use of the DART cookie enables it to serve ads to visitors based on their visit to sites they visit on the Internet. Website visitors may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.
